You say you can’t afford an attorney to help you create a trust.
Quite frankly, you can’t afford not to use an attorney to help you create a trust.
Granted, everyone wants to save time and money.
But when your family is concerned and your legacy is at stake, those are two areas that shouldn’t be compromised.
In their quest to skip attorney’s fees, consumers opt for a low-cost website to prepare wills or trusts. Whatever time or money you might be saving now, will only cost you—most likely, in spades—later when you can’t do anything about it.
Unfortunately, most don’t understand what they’re getting themselves into with an online document service—or better said—what they’re not getting when creating an online will or trust.
Online documents are no substitute for skilled Arizona estate planning attorneys. Documents cannot give legal advice. A licensed attorney can give advice and help you and warn you. Experienced estate planning attorneys can immediately spot opportunities and hidden hazards. A well-designed estate plan—tailor made to your specific situation—assures your assets go where you want them to go and when. Using a one-size-fits-all document often leaves room for interpretation (interpretation by the courts) as to what to do with your assets—and leaving misery and confusion for your loved ones to muddle through after you’re gone.
We live in a complex world with second marriages, stepchildren, certain assets like property in multiple states, a family business, or too many other unique situations to list that don’t fit into a one-size-fits-all will or trust (with no legal advice). We live in a litigious society and most people need help navigating those often-confusing and uneven waters with the personal attention a licensed attorney provides.
Some issues to consider: you can’t really compare the cost of an online, fill-in-the-blank document service with the services of a skilled Arizona attorney who tailor makes your entire estate plan to your specific needs. (And, truth is, some web-based document agencies will tell you to consult an attorney, anyway.)
Secondly, prices of an attorney and an on-line service can’t be compared because the services offered by each are very different. Try comparing the experience of eating at a fast food joint with a five-course meal at an upscale restaurant with an attentive staff. There is no comparison. You’re served food from a limited menu in a plastic box through a drive-up window … or your specific requests are honored and treated with courtesy and served with a white linen napkin. The majority of the population understands the difference in value and can compare that difference in the quality of service—you know, the “you get what you pay for” notion.
You’ve worked hard to make a living and take care of your family—in life—and hopefully—in death. Your family and loved ones deserve the five-star restaurant route … not merely fast food. You have one shot at a well-designed estate plan. If you fail to prepare, you prepare to fail (as my father always used to say). You’ll never know—but your family will and probably all too painfully, and costly. You don’t want to put your family or loved ones in a bind financially or emotionally your family or loved ones by not preparing properly now.
Consult with Wayne Gardner, a competent, licensed Arizona estate planning attorney who can help you put your distinct set of affairs in order—while eliminating a tangled, costly mess after you’re gone. You don’t want to be remembered as one who cut corners to save himself/herself a few bucks—only to leave family and loved ones fighting over the confusion, and costing them thousands.
See, you really can’t afford not to use a seasoned estate planning attorney when planning for the future for you and your loved ones.
